Terms of Use

These Terms of Use govern your access to and use of HOA Photo Packet, including the mobile application, website, support services, local project features, and any future cloud storage, shared project, subscription, company workspace, or contractor collaboration features. HOA Photo Packet is provided by Applied Open Source, LLC, located in Florida. Contact us at support@hoaphotopacket.com.

1. Acceptance of Terms

By downloading, installing, accessing, or using HOA Photo Packet, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app.

2. Who May Use the App

You may use the app only if you can form a binding agreement and are legally permitted to use it. If you use the app on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. Description of the Service

HOA Photo Packet helps users capture, organize, label, annotate, export, store, and share project photos and related documentation. Version 1.0 operates locally on your device. Version 2.0 may include cloud storage, accounts, shared projects, company workspaces, contractor/client access, and subscriptions.

4. Not Professional, Legal, Permit, Insurance, Engineering, or Construction Advice

The app is a documentation and organization tool. It does not provide legal, engineering, architectural, construction, or insurance advice, nor permit/HOA approval, code compliance, or inspection certification. You are responsible for verifying requirements with the appropriate authority.

5. User Responsibilities

  • Making sure project information, photos, addresses, notes, labels, dates, and exported packets are accurate and complete.
  • Obtaining permission before photographing, storing, exporting, or sharing property, people, vehicles, documents, or confidential information.
  • Reviewing packets before sending them to any recipient.
  • Maintaining your own backups of important files, photos, PDFs, and records.
  • Using the app in compliance with applicable laws, HOA rules, contracts, and professional obligations.

6. Accounts and Security for Version 2.0

If cloud or shared features are enabled, you may need an account. You are responsible for keeping credentials secure and for all activity under your account or workspace, and must notify us promptly at support@hoaphotopacket.com if you believe your account is compromised.

7. Shared Projects, Company Workspaces, and Contractor Access

Version 2.0 may allow project owners or administrators to invite participants to view, upload, comment on, edit, or export project content based on assigned roles. You are responsible for inviting the correct people, assigning appropriate access, and removing access when needed.

8. User Content and Ownership

You retain ownership of content you create or upload, subject to rights you grant us to operate the app. You grant Applied Open Source, LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, transmit, reproduce, format, generate, and back up your content solely as needed to provide, secure, support, and improve the app. You represent that you have all rights necessary to use your content through the app.

9. Prohibited Uses

  • Violating laws, privacy or property rights, contracts, confidentiality duties, or HOA rules.
  • Uploading or sharing unlawful, defamatory, fraudulent, abusive, or harmful content.
  • Misrepresenting project conditions, falsifying evidence, or creating misleading packets.
  • Uploading malware or content that disrupts the app or related services.
  • Attempting unauthorized access to accounts, projects, systems, or files.
  • Reverse engineering, scraping, overloading, or bypassing security controls except where permitted by law.

10. Purchases, Subscriptions, and Billing

Paid features may include export unlocks, premium templates, cloud storage, and subscriptions. In-app purchases on iOS or Android are generally processed through Apple App Store or Google Play according to their terms. Pricing, billing periods, renewal, and cancellation terms are disclosed at purchase. You are responsible for reviewing purchase terms before buying.

11. Cancellations, Refunds, and Restore Purchases

For purchases made through Apple App Store or Google Play, cancellations and refunds are handled by the applicable app store per its policies. If the app includes restorable in-app purchases, it will include a restore option. Cancellation may stop future billing but may not delete stored content; account deletion and subscription cancellation are separate processes.

12. Cloud Storage Limits and Data Availability for Version 2.0

Cloud plans may include storage, file size, project, user, or workspace limits. If limits are exceeded, we may restrict uploads, require upgrades, archive data, or provide notice. We may perform maintenance that temporarily affects availability and do not guarantee uninterrupted or error-free operation.

13. Backups

You are responsible for maintaining copies of important photos, PDFs, and records. Version 1.0 local-only data may be lost if your device is lost, damaged, reset, or uninstalled without backup. Cloud storage is not a substitute for your own business or legally required records.

14. Intellectual Property

HOA Photo Packet — including the app, website, trademarks, logos, designs, templates, software, and documentation — is owned by Applied Open Source, LLC or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works except as allowed by these Terms or applicable law.

15. Feedback

If you provide ideas, suggestions, or feedback, you grant us the right to use it without restriction or compensation. We are not obligated to keep feedback confidential or to implement requests.

16. Third-Party Services and App Stores

The app may interact with third-party services governed by their own terms and privacy policies. We are not responsible for third-party services outside our control.

17. Privacy

Your use of the app is also governed by the Privacy Policy, which explains how information is handled, including local-only storage, optional exports, and future cloud features.

18. Disclaimer of Warranties

HOA Photo Packet is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Applied Open Source, LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and error-free operation. We do not guarantee that a packet will be accepted by any recipient.

19. Limitation of Liability

To the maximum extent permitted by law, Applied Open Source, LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, claim denial, project delay, or permit/HOA rejection. Our total liability for any claim will not exceed the greater of the amount you paid us during the three months before the claim arose or one hundred dollars ($100).

20. Indemnification

You agree to defend, indemnify, and hold harmless Applied Open Source, LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your content, your use of the app, your violation of these Terms or law, or your infringement of another's rights.

21. Suspension and Termination

We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay, abused the service, or violated law. You may stop using the app at any time. Certain provisions survive termination, including ownership, disclaimers, limitation of liability, indemnification, governing law, and payment obligations.

22. Changes to the App or Terms

We may modify, update, discontinue, or remove features. We may update these Terms from time to time, posted in the app or on https://hoaphotopacket.com with a new effective date. Continued use after updates become effective means you accept the updated Terms.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The state and federal courts located in Florida will have jurisdiction over disputes, subject to any mandatory law that provides otherwise.
